The 2 BIG reasons why we aren’t likely to see the election called on November 3

The answer is that we may know, but it is very unlikely that the elections will be announced by a television station or a media channel on election night. And there are two main reasons for that:

Although the national polls largely match Hillary Clinton’s lead – she had a lead of 2.8 million votes – there is no doubt that President Donald Trump’s victory four years ago was a surprise to almost everyone. Among them are media organisations mocking elections in the hope of nominating individual bartering states as candidates and eventually announcing the next president long before they vote themselves.

As a result of this shock to the political system four years ago, which was largely due to Mr Trump’s ability to lure non-traditional voters to the polls, great caution will be exercised in making predictions about both the near winner and the winner.

The nightmare scenario for anyone trying to project the next president is the scenario that occurred in 2000, when Florida was called up and then withdrew when more information (and votes) became available.

Nobody wants to see that again, especially given Mr Trump’s repeated assertions, which he did not say, that the elections were somehow manipulated.

2) Early mass reconciliation:

Does the increase in early voting mean that fewer people will vote in person on Tuesday? Or will the turnout on election day be proportional to the early elections? Somewhere in between?

Nobody… …and I mean no one… knows the answer to those questions. And that means that those responsible for convening the states (and the White House) will be very alert to the signals sent out by their votes.

Add all this and you’ll understand why it’s good to stay up late on the third day. November (or very early November 4th) may not mean that you will know the identity of the next president.

Careful, careful… …always… …when you announce something as monumental as the next president of the United States. But it is even more important to be cautious when making such a prediction against the backdrop of a pandemic and with a man in the White House who has clearly expressed his (false) belief that something bad is going on during the vote.

It’s better to be right than the first. And that has never been as true as it was in this election.

Taiwan Covid: How they went 200 days without a locally transmitted case

Taipei’s response to the coronavirus pandemic is one of the most effective in the world. The last time a case was reported on an island of 23 million people was on Easter Sunday, the 12th. April, recorded on local TV. By Thursday he had confirmed 553 cases, of which only 55 were local broadcasts. Seven deaths have been reported.

Easter was an important milestone in the United States because President Donald Trump had said a month earlier that he wanted the country to be open and that he was jealous of the holidays.

At that time, 1.7 million people were infected and 110,000 people died from the virus – worldwide. On Friday, those figures exceeded 45 million cases and more than 1.1 million deaths, according to Johns Hopkins University.

Taiwan’s remarkable performance comes in a week in which France and Germany introduced new blockades and the United States discovered a record 88,000 cases in more than a day. On Wednesday alone, 4,188 cases were identified in the state of Florida, which has a population comparable to Taiwan and is home to about 21 million people.

Taiwan has never had to impose strict restrictions. Nor has it resorted to drastic restrictions on civil liberties such as in China.

Instead, Taiwan focused on speed. The Taiwanese authorities initiated the procedure on 31 December 2008. December 2019 with the screening of passengers on direct flights from Wuhan, where the virus was first detected, at a time when the virus was mainly the subject of rumours and limited communication.

Taiwan confirmed the 21st. In January a first case of this new coronavirus was registered, and subsequently the inhabitants of Wuhan were forbidden to travel to the island. All passengers arriving from mainland China, Hong Kong and Macao must pass through a checkpoint.

All this happened before Wuhan himself was killed on the 23rd. January in the prison camp. Until March, Taiwan had denied entry to the island to all foreign citizens with the exception of diplomats, residents and holders of special entry visas.

But Taiwan has advantages that its Western counterparts do not have.

One of them is the geography… Because Taiwan is an island, it is easier for officials to control entry and exit across borders.

Taiwan also had experience on his side. After surviving a fatal outbreak of Severe Acute Respiratory Syndrome (SARS) in 2003, Taiwan has been working to build its capacity to fight the pandemic, Taiwan’s foreign minister Joseph Wu said in an interview last month.

When we heard there were cases of clandestine pneumonia in China, where patients were treated in isolation, we knew it was something like that, he said.

The authorities have activated the Central Epidemic Command Centre of the island, set up after SARS to coordinate actions between different ministries. The government has also increased the production of face masks and protective equipment to ensure a continuous supply of PPE.

The government has also invested in mass trials and the rapid and effective pursuit of contacts.

Former Taiwanese vice-president Chen Chen, who is an epidemiologist by training, said the blockade was not perfect. Chen also said there is no need for mass trials in mainland China, where millions of people are screened for a handful of cases.

According to him, the best way to locate Covida-19 is a very careful monitoring of contacts and a very strict quarantine of close contacts.

The runner who beat COVID-19 — and then ran the virtual 2020 NYC Marathon

Tatiana Rojas woke up at 2 a.m. and felt as if someone had set her lungs on fire.

She suffocated in the air, but her nostrils were blocked and the wheezing didn’t give enough oxygen.

She decided to go to the kitchen to get some steam. She hoped it would allow her to clear her windpipe, if only for a while.

Rojas, 59 years old, ran several marathons, but it was almost impossible to get from his room to his kitchen that night. After every second stage she stopped and continued to cling to the retaining walls and swallow the air that seemed to surround her but was nowhere inside.

I’m gonna die here, she remembers thinking.

Somehow, in a trance, she went into the kitchen and focused only on the next step. She was about to boil some water, and just when she thought she was going to faint, she inhaled hot fumes that released a clogged nose long enough to give her a decent breath. She sat on the kitchen floor for a long time and kissed a bowl of water for her beloved life.

Rojas felt this way for three weeks, and in that time she probably slept five hours a night, if she was lucky. It was mid-May, a month after the KOVID-19 positive test, and during those endless days it was easy to believe that she would never win.

But on the 23rd. In June she got her first negative test. And five months after this life-changing experience, she ran a marathon in New York… practically… after beating KOWID-19.

When the world came to a standstill in mid-March, Rojas, the coordinator of the case management team at New York’s Elmhurst Hospital, kept coming to the hospital with gowns and masks. Before the team is on the 23rd. When they met in March, she heard that the virus had infected a hospital clerk, but didn’t know who it was. She felt exhausted when she went to a meeting, but felt she either had a psychosomatic reaction to the news or general fatigue. At the end of the day she had a headache and sore throat.

She called her doctor, prescribed amoxicillin – she didn’t have a fever – and decided she could handle it. She cooked, walked a few miles a day, like most of her life, and worked from home. Her husband, Juan Carlos Nattes, had similar symptoms, sometimes had a fever, but nothing was out of control.

But, uh…

Then, two weeks later, she woke up one morning with a sharp pain in her lungs. She tried to catch her breath and felt herself fall deeper into the water.

After he died on the 16th. In April, after going to the emergency room without taking the KOVID-19 test, she found a free test center two hours away – in Far Rockaway – and went there. Two days later, her test came back positive, the man negative.

I’ve been suffering for a month; what is this disease and what’s going to happen now? She remembered how scared she was of herself. And then a smaller voice in the back of your head: I can’t stop walking. But I can’t even breathe. What am I supposed to do now?

As her husband got better, her condition worsened. He cooked for her, made sure she had enough pillows to support her head so she could breathe more easily, and did a minimum of shopping to keep the house safe.

I was so scared to see her like this… I was there to help him, but we all felt helpless. We didn’t know what this disease did to him, said Rojas’ husband.

She wouldn’t want those three weeks on her worst enemy. Her body shook every time she tried to leave.

But, although it seems impossible, she’s thinking of running away. For the coronavirus she used her lunch break every day to walk 5 kilometres around the Elmhurst hospital. Three times a week she changed after work and walked five miles from the hospital house. The idea of running gave him a new energy charge. Something to look forward to. Something to look forward to when this is all over.

Rojas worked as a sports teacher in Bolivia and spent a few hours in the school stadium, where she either coached secondary and high school students or did intensive aerobics herself. When she wasn’t at the stadium, she was running. Even then, one of Rojas’ biggest dreams was to organize a marathon in New York. She read about the people who ran the marathon, the people who had to be brought to the finish line, the people who crawled to the finish line, and she thought: Wow, this deeply human experience. I want to be a part of it.

Then she emigrated to the United States, had three children and life stood in her way. After the birth of her third child and knowing that this would be her last pregnancy, she ran her first marathon in New York City. She has already started running half marathons and longer races to get back in shape after giving birth.

But the results of the marathon lottery came in, and she wasn’t selected.

For several years it made a request and received the same reply: Dismissed. Just before the New York marathon of 2010 she thought I would turn 50 next year. This is the last time I try, and if I can’t, I’m leaving.

A few weeks later, she got a letter. Congratulations, you’re taking part in the 2010 New York Marathon.

It was like a miracle, she said. And it changed his life.

She trained alone, immersed herself in the knowledge of her gymnastics teacher and walked 5 km every day in preparation for a longer weekend jogging session. She ran her first marathon a week before her 50th birthday and completed it in seven hours and 37 minutes. The last two hours have been difficult, her brain constantly convinced her that it was too difficult, that her legs couldn’t take a step. But she kept pushing, and as she crossed the finish line, even though there was no ribbon, she felt an invisible energy pushing her across the line. Then she got her medal and cried uncontrollably when she felt the medal in her hands.

She imagined the end of the New York marathon so often, but she was not ready for the doors of emotion, a strong sense of gratitude for her body and mind. It was as if she shared the deepest of her being with every runner who ran a marathon in front of her – the energy was so tangible.

She said it was more beautiful than I could have imagined.

Since then she has participated in the 2017 and 2019 marathons in New York City and in eight half marathons. She ran her fastest marathon last year at 6:21:55.

When KOWID-19 hit her like a truck, she imagined the thrill of climbing the last hill in her first New York marathon. She remembered how she turned around the last kilometer to see a swarm of people at the finish line. She remembered how the fresh New York air in November made her feel as she walked through difficult areas.

Even before her test came back negative, she made a decision. She wanted to run another marathon in New York. Thanks to KOVID-19 the marathon will be virtual this year, and the window for jogging – 17th place. October – 1. November.

A few days after the negative test in June, she noticed that her body was no longer trembling when she walked. So she decided to go out for the first time. Clary made a one-and-a-half loop to shore and back, a stage that was considerably delayed towards the end. When she got home, she got on the couch. She stayed in bed for three days and recovered after a walk. But three days later, she tried again.

The shoes for the second walk were harder than most things I’ve ever done in my life, but I didn’t think so. I won’t let this virus win. Now that I’m free, I’m gonna work to get my body back.

At the end of July, five weeks after the negative test result, she had walked her first 5 kilometres. It wasn’t the fastest, or even the closest, but she still felt an enormous sense of satisfaction at the end.

A few weeks ago she ran 22 miles around Central Park, due to what this year’s New York Virtual Marathon will look like. Last year she ran her first virtual marathon (also known as the New York Marathon), and it took a lot more discipline and strength to run 26.2 miles through the same district without guides or supporters to help her through the ups and downs.

You have to look deep inside yourself if you think you can’t do it, she said.

The 25th. In October Rojas started a virtual race on 60th Street and 1st Avenue at 4:30 am and ended at Flushing Meadows Park in Queens, via Central Park. When she reached 20 miles, her knees hurt like they were on fire, and through the tears that ran down her eyes, she kept thinking My God, I’ve been through so much, please, just let me finish this race.

She walked the last six kilometres slowly and deliberately and took the silence of Manhattan with her after the early morning and the pandemic. As she slowly walked to the finish line and was picked up by her husband and friend – she crossed the finish line at 7:31 a.m. – she put her hands in the air and didn’t believe her body had let her walk 26.2 miles.

For them, running a marathon – especially on the 10th day of the race – is a big challenge. It was the 50th anniversary of her first – a few months after suffering from a disease that killed more than 225,000 Americans, her way of standing up for all those who couldn’t.

I want to run now and not stop. I want the power and energy that the coronavirus has taken from me. That’s why I’m here.

Facing Surge in Virus, European Countries Try to Fix Their Covid Apps

European health and public authorities are improving applications for contact tracing as a new wave of 19 cases of Covida has spread in the region and new blockades have been put in place.

Officials who control the tools say the problems vary depending on privacy concerns, the difficulty of understanding how people use the application, and the reluctance of citizens to download the application.

Data protection is not something that comes to mind when someone is developing an application, said Victor Claws, a senior specialist at the Dutch Data Protection Authority, at a conference organised by the European Data Protection Agency last week. But Mr. Claws sees the problem. For example, the technology may still affect the privacy of users, because you can see who receives multiple random codes indicating that they are close to other users with a positive Covid 19 diagnosis.

This month the Portuguese government proposed to make Stayaway Covid’s application mandatory, but it rejected the idea in less than a week, despite widespread criticism. Approximately 2.4 million people have downloaded the application since its launch in September.

The widespread use of Google and Apple technologies is disappointing for some European data protection authorities and government officials. France does not use it, but other European countries that have applications use it.

There have been some incredible highs and lows, such as the spectacular Champions League won at St Germain de Paris in March 2019, and some humiliating lows, such as the recent 6-1 defeat at home against Mourinho Tottenham in the Premier League earlier this month. Solskjaer did not return to the Champions League with United until 2020, but he led the team to beat in three cup semifinals. He oversaw the emergence and development of local talent, including Marcus Rashford and Mason Greenwood, but also struggled to build a strong defensive and cohesive team.

So how is Solskjär preparing for the height of the century at the helm of United – winning 56 of 99 races, how does he measure that? Is United going to fall back into the line under their former player, or are they going around in circles? ESPN tried to find the answer.

Recruiting players for United has been a constant challenge in recent years, because the club has gone from one costly mistake to another, especially during Van Gaal’s term of office. Too often Solsker is overwhelmed, and the biggest concern is his inability to act when things go wrong. This season alone, the home defeats of Palace and Spurs after United’s delay have gone from bad to worse, and the turmoil among players on the pitch makes it clear that the manager needs to give better instructions.

A high-level coach makes adjustments to change the game in a positive way. This rarely happens to Solskier.

Solskjar managed to get rid of the players who couldn’t play, but he got stuck with the managers who dropped him on the transfer market several times. After 99 races we still don’t know how Solskjaer United will get back on top. He used a 4-3-3 formation, played with three players on their backs and placed the diamond in the middle of the field, but always seems to try to find what works best for his players. It’s hard to imagine that people like Pep Guardiola, Jurgen Klopp, Mourinho or Mauricio Pochettino still don’t know how to play the starring role after 99 games, but every time United plays, it’s a gambling game about how they’re going to play.

Of course, it’s the only way to succeed, but under Solsker there’s still a mess.

For every positive result with Solskjaer it is easy to answer negative. He did a lot of good in his time and that indicates a lack of leadership within the club before he arrived, which made United’s predictions under his leadership so difficult.

Even now, with 99 games in progress, it still has to print the bad decisions made in the previous modes. But after almost two years there really should be a clearer roadmap than the one we have now. The defense still needs reinforcements and midfield remains a mystery because of the conflicting qualities of Solskjar’s players. As far as the attack is concerned, United can threaten even the best opponents, but if their counter-attack approach doesn’t work – especially against the weaker teams – they don’t have a plan B.

In the end United is now in a better position than when Solskjær arrived, but progress is slow and disappointing. And even if they meet Bundesliga leaders RB Leipzig on Wednesday, it will come as no surprise as United slip up against Arsenal on Sunday.

During the great periods of Solski’s reign, he took two steps forward and one step back, and when he was getting ready to celebrate his 100th birthday, he was also a great leader. When the game’s over, she’s still standing.

Amazon Claims Prime Video Users Don’t Legally Own Purchased Content

Amazon claims in court that its users do not own digital content purchased on Amazon Prime Video. When someone buys a film or series to watch it via a streaming service, they pay a limited license to watch the video content. This means that while customers may view the content indefinitely, Amazon has the right to remove the content at any time due to license restrictions imposed by the provider or for other reasons. Despite the fact that most subscribers do not pay attention to this information, it complies with Prime Video’s terms of use.

One person who noticed the fine print is Amanda Cowdel, a woman who sued Amazon in April for unfair competition and false advertising. David Biderman, a lawyer, notes that the model has acquired 13 important titles since the complaint was filed, and argues that the complaint has no factual basis, since Amazon has not removed any of the materials acquired by the model, making the complaint purely hypothetical.

Plaintiff alleges that Prime Video, a service offered by defendant Amazon that allows consumers to purchase video content for streaming or download, is misleading because such video content may not be available if the Amazon license is revoked or modified by a third party, writes David Biderman in his petition. The complaint vaguely refers to online comments about the alleged potential injury, but not to the purchase of Prime Video, which is not available to the complainant. In fact, all Prime Video material purchased by the complainant is still available.

Biedermann also points out that it is not necessary to read the small print in order to be legally bound by it. The terms of the contract can be read by anyone before signing or buying the content, and the argument behind this is that the consumer should read it before agreeing to anything. The purchase clause in an online consumer transaction is valid and enforceable if the consumer has been sufficiently informed of the terms and conditions of the service, said Mr. Biderman.

What happens next depends on the legal system. After all, Amazon might go to court, but attention to this case should make a lot of people realize that they don’t necessarily own the movies and television shows they buy on Amazon Prime Video. Although buying digital content is often much more convenient, buying physical media seems to be the best way to ensure that you can always do so. Supreme Court lets some states count mail-in ballots received after Election Day but not others

The court, issuing some of the orders after hours, has navigated a minefield with justices seeking consensus and coherence where possible, hindered without the benefit of a full briefing schedule. The situation was complicated by the fact that emergency requests came in before and just after Justice Amy Coney Barrett took the bench.

On the face of it sometimes the orders seemed contradictory. In North Carolina, ballots can arrive up to nine days after Election Day; in Pennsylvania, ballots can arrive up to three days late — for now; and in Wisconsin, the court said ballots must be in by election night.

Some themes have emerged. It is now clear that four conservative justices are ready to take a sharp right turn when it comes to the power of state legislatures to set the rules for elections. In addition, Chief Justice John Roberts served as swing vote at times, but still worked to preserve the court’s institutional legitimacy, and the liberals on the bench again expressed their fear that the pandemic could disenfranchise voters in some states.

All the while, Barrett, Trump’s latest justice, has stayed out of the political fray for the moment.

Wisconsin: Mail-in ballots must be received by Election Day

A federal district court in Wisconsin had allowed ballots to be received up to six days after the election, but a federal appeals court had blocked the order. The high court upheld that block in a 5-3 ruling on Monday.

Here, Roberts’ role was critical, and he sided with the other four conservatives (the ruling came down before Barrett joined the bench). He explained that the federal district court had “intervened in the thick of election season” and intruded on the state lawmaking processes — which didn’t allow for extending the mail-in deadline. The court made clear that federal courts shouldn’t interfere to change state election rules so close to the election.

In concurring opinions, Justices Neil Gorsuch and Brett Kavanaugh sent strong signals about the power of state legislatures.

“The Constitution provides that state legislatures — not federal judges, not state judges, not state governors, not other state officials — bear primary responsibility for setting election rules,” Gorsuch wrote. That would make a big difference in post-election challenges particularly if the legislature and governor are from different parties. It conceives of a more robust role for the Supreme Court when reviewing lower courts.

Kavanaugh went farther. Echoing Trump, he said states are within their rights to set Election Day deadlines “to avoid the chaos and suspicions of impropriety that can ensue if thousands of absentee ballots flow in after election day and potentially flip the results of an election.”

Also key is that Kavanaugh referenced a three-justice concurrence in the 2000 Bush v. Gore decision suggesting that state courts may not have the final say when it comes to election rules. This could be a radical shift to the right in the years to come as it applies to voting rights.

The three liberals were left to stress that the courts had stepped in because of the pandemic and they feared voters would be disenfranchised during the pandemic.

Pennsylvania: Mail-in ballots can arrive up to three days after Election Day — for now

In Pennsylvania, the circumstances were different, and the case came up to the court twice. Unlike Wisconsin, where the lower court challenges played out in a federal court, here a Pennsylvania state Supreme Court decision was central to the challenge. That state court had allowed mail in ballots to count if they are received within three days after the election — even without a legible November 3 postmark.

Republicans asked the court to step in to reinstate an Election Day deadline, but on October 19, the court announced it was deadlocked 4-4, meaning the three-day extension could stand.

Barrett was not yet on the bench and Roberts was the swing vote, this time siding with liberals. Roberts sees a difference in how state and federal courts should look at an issue. As he said in the Wisconsin case: state courts may have authority to apply their own Constitutions, but federal courts shouldn’t intrude too close to an election.

Republicans brought their challenge back to the court just as Barrett was confirmed hoping her vote might make a difference. This time they asked the justices to expedite the case and hear it before Election Day. Wednesday, the justices declined to grant the request, and Barrett for her part didn’t participate in the case.

There were no noted dissents, but Justice Samuel Alito, joined by Thomas and Gorsuch, made crystal clear the reasoning. “I reluctantly conclude that there is simply not enough time at this late date to decide the question before the election, Alito wrote.

But Alito noted that Pennsylvania has agreed to segregate the votes that could be in play for the election — those that arrive after Election Day until three days afterwards — and didn’t foreclose a challenge after the election that would only likely occur in the rarest of circumstances.

“There is a strong likelihood that the State Supreme Court decision violates the Federal Constitution,” Alito said.

If that line of reasoning prevails — that state courts are usurping the authority of state legislatures to set the rules — it could have vast post-election consequences when it comes to ballot counting and other disputes.

North Carolina: Mail-in ballots can arrive up to nine days after Election Day

The court rejected two exceedingly complicated challenges brought by the Trump administration, Republicans and state legislators, letting stand an accommodation allowing ballots to arrive up to nine days after Election Day, so long as it’s postmarked by November 3.

Barrett once again did not participate, and Thomas, Alito and Gorsuch registered their dissents.

The state legislature had established a three-day extension for mail-in ballots in June, but later a federal appeals court had allowed the nine-day extension that was set by the State Board of Elections amidst the pandemic, as part of a legal settlement.

What’s unknown is the vote of Roberts and Kavanaugh. It is possible the vote was split 4-4, and Kavanaugh agreed not to note his vote to highlight the deadlock, but when the court issues orders such as this one, only justices who wish to publicly note their dissents are named.

Gorsuch, joined by Alito, echoed what he had said in the Wisconsin case: the power of the state legislature to set election rules.

The Barrett factor

What remains unclear going forward is the Barrett factor.

By saying she was not read in enough to vote on the cases, Barrett shielded herself from criticism that her very first votes on the bench went to the heart of politics, especially given her contentious nomination process and arrival on the bench just before the election.

It was a move likely endorsed by the chief justice who cares deeply about protecting the institutional concerns of the court.

But she pointedly did not recuse herself from election cases in general. That means her vote could be in play if the Pennsylvania case comes back, or, in the exceedingly rare circumstance that the court is called upon to decide the election. With time, it will be revealed if she is part of the wing of the court that wants to move things radically to the right when it comes to election law.
